Lemon law resales shinanigans

Hi

 

I am new here but I am so po'd and the local Ford dealer that I am vening to everyone I can. The Lewis Auro Group in Fayetteville, Ark has the sleezist used car sales that I have ever seen. The history is I bought a used 08 Ford Shelby GT500 Mustang from them. They claimed that there was nothing wrong with the car. After the purchase I find out the it was a factory lemon law buyback, Since I was never told of this fact before hand I went back to the dealer to see what could be done about it. I talked to Shelby Lewis who is in charge of the used car department. He told me that they go by what is on the car fax. The car fax does not show it being a lemon. But the car fax does show that it had the title turned back to the factory. I explained that the car has right on the door next to the vin sticker a sticker stating that it was a factory lemon law buyback. I also showed him the oasis report on it that shows it being bought back. He still insisted that since the car fax did not show it they did not know about this and therefore not responsible for the error and therefore wojld do nothing. He did offer to buy it back at a loss to me. All I wanted was some compensation for the difference between the lemon law resale price and the regulat resale price. But no go so I am letting everyone know not to deal with Lewis Ford which is part of the Lewis auto Group. This has got me so mad that I am thinking of locating an attorney and see what can be done. The Arnansas State law says the lemon law cars MUST be revealed before resale which they did not. Thanks for listening.

I had a car in 1993 that was bought back by Ford and was supposed to have been crushed, according to Ford. About a year later I was contacted by the "new owner" as he found evidence that the car had been previously owned. Somehow the registration was left in the car. This car had actually been transported by Ford to another state and resold.According to the new owner the car had never been re-branded, as required by CA law. He filed a lawsuit against Ford and the dealer who resold the car and it is my understanding he won.

Why did you even buy it when you saw the sticker????

 

Can't be mad at them when you KNEW what you were getting into.

Whats the vin. I would like to look to see if I can figure out why it was bought back.

I have seen a couple vehicles bought back but couldn't find any thing wrong. Most turned out to be owner didn't want it anymore so they came up with complaints. We had a mustang from auction that was a buy back. Report showed customer was over filling fuel tank.

Come to find out it had a problem. New owner and evap system was full of fuel again. Replaced tank never a problem again.

It does suck, you should be compensated. At least get a premium care warranty for free.

...and you bought the car anyway? Now you want compensation for the 'lost value'? The time to negotiate that was during the purchasing process...Ford properly labeled the car and it is on the Oasis report as well...did the used car manager accidentally (on purpose) miss the placard AND the report in the service bay? That's his story and he is sticking to it...

I did not see the sticker until I went looking for the color code on the door plate AFTER I had already paid for it. It was at that time I saw the buy back sticker and went back to the dealer. They NEVER pointed that out to me or in any way told me that it was a buy back. I was NEVER informed or that fact. So far the response I have gotten from Ford is that each dealer is independent and they have no control over how they do business. I would think they cwould care about how dealers representing their brand dealt with their customers. I have been a loyal Ford man for 50 years and I might have to rethink that seeing how this is going.

Because I did not see the sticker until AFTER I bought it. They NEVER said anything about it being there or that it was a buy back. If I had known about the buy back ahead of time I would have wanted a discount. Too bad they never informed me of it and now say too bad.

You will have a difficult time trying to litigate this....the dealership will claim that the car was properly labeled and that you were informed of the disclosure...re-read your sale documents, I am willing to bet that somewhere, 'hidden', is a statement to that effect. Not endorsing what the stealership did to you, but this is a prime example of Caveat Emptor ....

That might be so but what I have from them says nothing about that. Actuall all they gave me was a sales form showing the cost and final price, a road sid assistance policy, a 3 month power train warranty, and a odometer certification. That is it. Nowhere on any of those is it noted as a lemon law buy back. Will have to wait and see where this goes. But I am not done yet.

I know there is paperwork the 2nd owner needs to sign for lemon law disclosure, but after that I have no idea what the disclosure requirements would be. As a 2008 Shelby, it is likely that the car was lemon lawed by 2010 at the latest and you are at least the third owner. Best of luck - any Ford store should have run an Oasis during their recon process. I'm not sure if there is legal recourse.

What I have is the car fax which does not state in their lemon law section as being a lemon. It does state on the detailed history as being sold on 1.21.08. It then has "title or registration transfered to manufacturer" on 7-21-10 and being resold at auction on 8-30-10. This would have been the date Ford bought it back. On the oasis report it shows a reacquired veh war exp on 9-16-11 distance 16089. The sticker does say that it came with a warranty for one year. Another person purchased the car on 9/17-10 and resold when I bought it on 9-4-13 with 31200 miles on it. The second owner liver in OK and I do not recall at this time if the title had lemon law buyback on it or not when I registered the car here in Arkansas. I have not received my title yet so do not know if it is on that or not. At this time I am just trying to find out what happened and why I was not told of this fact and why they refuse to acknowledge they knew about it. Theeir claim is they have so many car they cannot run a oasis report on them.

The disclosure only applies to the original purchaser after the buyback - the one who bought it before you did back in 2010. I don't think there was any requirement by the dealer to disclose anything - caveat emptor:

 

The written disclosure required by this section applies to the first resale to a retail customer of the vehicle in Arkansas by the manufacturer or its authorized dealer.

that is posoble. Don't know. I have filed with the Ar comsumer protection so will let the tell if it is or is not.

My first 06 mustang gt got crunched unloading from the hauler...long story, but in the end i followed that cars vin to see whatever happened to it... Was told transport took ownership of it, some place called liberty ford repaired the decklid / quarter panel damage, and repair was documented properly... 3 months later the car somehow got sold in west virginia as a factory car, no disclosure of the repairs documented in ohio.

It happens, wether by dealers , shippers, or the factory, who knows- but its still not right. Hopefully the repairs were 'good as new' , but in my thinking, thats not really possible.

Many years back (well before Car-Fax ) a row of new pickup trucks was rear ended pushing them into one another. There was several trucks that had front end and rear end body damage. All were run through the body shop and sold "new" on the lot. I am not sure that would show on a modern car-fax report or not.

 

A co-worker test drove a new Chevy pickup truck and while in the test drive the temp gauge pegged hot and the idiot light came on. He told the sales guy riding along and asked if he wanted him to stop and pull over. The sales guy said " Its got to be an error and just drive it back to the dealership". Once they got back my friend popped the hood and learned there was no lower radiator hose clamp , along with no coolant now. The engine was grossly overheated. The sales guy continued to hard sell the truck and my friend said the motor is likely damaged and he was not interested. That same truck was back on the lot the next day and I guarantee the person that buys it will likely never be told.

 

These kind of practices should not happen and the buyer should not have to guess questions to ask about the "new" vehicle they are considering purchasing.

My parents always ordered new cars and would never buy anything sitting on the lot. Now I can understand why and it makes you think...........
